PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. BY DOWNLOADING, ACCESSING, OR USING WEARCOMPARE (THE "SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT DOWNLOAD, ACCESS, OR USE THE SERVICE.

Description of the Service

WearCompare is a private beta application that reads sleep, heart rate, and related health data you have authorized through Apple Health (HealthKit), and displays summaries, hypnograms, and side-by-side comparisons of that data across the wearable sources you use (for example, Apple Watch, Oura Ring, and Garmin devices). The Service also allows you to export a personal copy of your Health data as CSV or JSON files via Apple's share sheet.

The Service does not manufacture, sell, or control any of the third-party wearables or apps (such as Oura or Garmin Connect) that write data into Apple Health. We display whatever data those sources have made available to Apple Health and are not responsible for its accuracy.

Eligibility

The Service is intended for users age 18 and older, located in the United States. By using the Service, you represent that you meet these requirements.

Private Beta

The Service is currently offered as a private, invitation-only beta and is gated by a shared access password provided to testers. You agree to keep this password confidential and not to share it with anyone who has not been separately invited to the beta.

Beta software is provided for testing and feedback purposes. It may contain bugs, may behave unexpectedly, may change significantly, and may be modified, suspended, or discontinued at any time, with or without notice, at our sole discretion.

Not Medical Advice

WearCompare is intended for personal, informational, and research-comparison purposes only. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Nothing displayed or exported by the Service should be relied upon as a substitute for professional medical judgment. Always consult a qualified healthcare provider with any questions about a medical condition, and never disregard professional medical advice or delay seeking it because of anything you see in this Service. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately.

Your Responsibilities

You are responsible for maintaining the confidentiality of your beta access password, for all activity that occurs through your use of the Service, and for reviewing and controlling which Health data categories you authorize the Service to read via iOS Settings. You agree to use the Service only for lawful purposes and in accordance with these Terms.

Intellectual Property

The Service, including its design, features, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you in the Service or any of its content.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA DISPLAYED WILL BE ACCURATE OR COMPLETE, PARTICULARLY GIVEN THE SERVICE'S BETA STATUS.

HealthKit Data Privacy WearCompare accesses health metrics solely through Apple HealthKit based on the permissions you explicitly grant in iOS. We do not use HealthKit data for advertising or marketing purposes, nor do we sell, rent, or transfer your HealthKit data to third-party data brokers or advertisers. All processing and local CSV/JSON exports are under your direct control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Any dispute that cannot be resolved informally shall be settled by binding individual arbitration rather than in court.

You agree to defend, indemnify, and hold harmless WearCompare and its developers from and against any claims, liabilities, damages, judgments, or expenses (including reasonable legal fees) arising out of your violation of these Terms or misuse of the Service.

Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we discontinue the beta program. You may stop using the Service at any time by deleting the app.

Changes to These Terms

We may modify these Terms from time to time, as indicated by the "Last updated" date above. If we make substantial changes, we will make reasonable efforts to notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, do not continue to use the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Montgomery County or Prince George's County, Maryland (or the US District Court for the District of Maryland), and you consent to the personal jurisdiction of such courts.
